These Terms and Conditions (“Terms”) set forth a legally binding agreement between you and Luis Legar Holdings, LLC. (“RQM,” “we,” “us,” “our”). Please read this agreement and our Privacy Policy carefully prior to using Requestify.net, any related subpages, applications, mobile applications for iOS and Android, desktop applications for Windows and Mac, and/or mobile versions (collectively, the “Platform”) or registering for the Service (as defined below). By using the Platform or registering for the Service, you become a party to this agreement and are bound by the terms herein, whether you are a visitor, member, or user (collectively, the “User”). If you do not agree with all of the Terms, discontinue your use of the Platform and the registration process. Your continued use of the Platform will constitute your binding acceptance of the Terms herein.
Luis Legar Holdings, LLC provides the Platform, which includes our Website and our mobile and desktop applications for iOS, Android, Windows, and Mac. The Platform is a cloud-based software-as-a-service (SaaS) that allows audience members at live and virtual events to like specific songs and submit song requests, tips, comments, and shout-out requests to Disk Jockeys (DJs) and live music performers in real time during events. It allows DJs and live performers to better understand audience preferences both at a specific event and over time.
You will be provided access to the Platform for a fee as a registered member (“Member”). Members can use the Platform to manage their libraries and access additional features through a subscription service (collectively, the “Service”).
You must be at least 13 years old to use the Platform, and at least 18 years old to register for a paid Membership.
During registration, you will submit your email and a password to create an account ("Account"). You are responsible for maintaining the confidentiality of your Account and password and for restricting access to your Account. You are solely responsible for all activities that occur under your Account. You must immediately notify "RQM" of any unauthorized use of your Account.
You represent and warrant that the registration information you provide is accurate, complete, and current, and you agree to maintain and update this information as needed.
"RQM" reserves the right to modify the Platform, these Terms, and the Privacy Policy at any time, at our sole discretion. Such modifications are effective upon posting by "RQM".
It is your responsibility to review the Privacy Policy regularly, which is available at https://requestify.net/privacy-policy.
Your continued use of the Platform following any modifications constitutes your binding acceptance of the updated Terms. If any modification is unacceptable to you, your only remedy is to terminate your Account and cease using the Platform immediately.
The collection and use of information you provide are governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully at https://requestify.net/privacy-policy.
While "RQM" strives for uninterrupted access to the Service, you acknowledge that occasional interruptions may occur due to maintenance, upgrades, Acts of God, governmental actions, pandemics, or other circumstances beyond our control. "RQM" is not liable for any interruption or discontinuation of the Service.
5.2 Restrictions on UseBy using the Service, you agree not to share files through the Platform or with any third parties. "RQM" reserves the right to permanently terminate your access to the Service for violations, without a refund.
By registering for the Service, you agree to pay the applicable fees, which may be billed monthly or annually (“Recurring Fee”).
6.2 Recurring BillingYour Recurring Fee will be charged automatically until you cancel your Membership by logging into your Account and selecting “Cancel Membership” on your billing page.
6.3 Responsibility for FeesYou agree to pay all applicable charges related to your Account. ALL PAYMENTS ARE NON-REFUNDABLE.
6.4 Past Due Balances"RQM" reserves the right to deactivate your Account for nonpayment and pursue collection of any outstanding balances, including legal costs and attorney’s fees.
6.5 TaxesYou are responsible for all applicable taxes arising from your use of the Service.
6.6 Changes in Pricing"RQM" reserves the right to change pricing at any time and will notify you via your registered email address.
We may terminate your access to the Service at any time, for any reason or no reason, without prior notice. No refunds will be given.
7.2 By YouYou may cancel your Membership at any time through your Account Settings. No refunds will be provided for any amounts already paid.
The Platform, including all content, technology, and intellectual property, is owned by "RQM" or its licensors.
8.2 RestrictionsYou may not modify, reverse engineer, copy, or distribute the Platform or its content without prior written consent. You agree to indemnify "RQM" for any violation of this Section.
8.3 Reservation of RightsAll rights not expressly granted herein are reserved by "RQM".
8.4 TrademarksREQUESTIFY® is a trademark registered with the United States Patent and Trademark Office and is owned exclusively by Luis Legar Holdings, LLC. The Requestify name, logos, slogans, and other brand features, together with any related trade names, service marks, and trade dress (collectively, the “Requestify Marks”), are the property of Luis Legar Holdings, LLC. Requestify.net and its subdomains make up the official website and the only website authorized to operate under the Requestify Marks.
Nothing in these Terms or on the Platform grants you, by implication, estoppel, or otherwise, any license or right to use the Requestify Marks without the prior written permission of Luis Legar Holdings, LLC. Without that permission, you may not:
Any unauthorized use of the Requestify Marks is strictly prohibited and may constitute trademark infringement, dilution, or unfair competition under applicable law. "RQM" reserves the right to pursue all available legal remedies.
8.5 Members’ Use of the Requestify NameWhile your Membership is active, you may refer to the Platform by name and share the links "RQM" provides for your public profile, events, and QR codes so that your audience can find and use the Service. This limited permission is non-exclusive and non-transferable, and it ends automatically when your Membership ends. Any goodwill arising from your use of the Requestify Marks belongs solely to Luis Legar Holdings, LLC. Your profile subdomain (for example, your-name.requestify.net) is provided as part of the Service; it remains the property of "RQM" and does not grant you any ownership interest in the Requestify Marks.
8.6 Third-Party TrademarksOther trademarks, service marks, logos, artist names, and song titles that appear on the Platform, including those supplied by third-party services such as Spotify, Stripe, PayPal, Venmo, Zelle, and VirtualDJ, belong to their respective owners. They are used for identification purposes only. Their use does not imply that those owners are affiliated with "RQM" or endorse it.
8.7 Reporting InfringementIf you believe that any person or website is using the Requestify Marks without authorization, or that content on the Platform infringes your intellectual property rights, please contact us at help@Requestify.net.
When accessing the Platform or App, you are granted a limited, non-exclusive, non-transferable license to use the Platform solely in accordance with these Terms.

You must comply with all applicable laws while using the Platform.
By submitting, uploading, transmitting, or otherwise providing any content, data, tips, song requests, shout-outs, preferences, feedback, or other information through the Platform (collectively, “User Submissions”), you grant Luis Legar Holdings, LLC (“RQM”) a worldwide, perpetual, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, create derivative works from, distribute, display, and perform such User Submissions for the purposes of operating, improving, marketing, and developing the Service.
You acknowledge and agree that:
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. "RQM" disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
You agree to indemnify and hold harmless RQM, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.
All payments and fees paid to "RQM" are non-refundable.
These Terms are governed by the laws of the State of Florida, without regard to conflicts of law principles. Any disputes shall be resolved exclusively through binding arbitration with the American Arbitration Association, located in Miami, Florida. Each party shall bear its own attorneys’ fees and costs.
YOU AND "RQM" AGREE THAT EACH MAY BRING CLAIMS ONLY IN THEIR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless agreed otherwise, no arbitrator or judge may consolidate claims from multiple parties.
You may not assign your rights under these Terms. If any provision of these Terms is found invalid, the remaining provisions shall remain enforceable.
These Terms, together with the Privacy Policy, constitute the complete agreement between you and "RQM" regarding your use of the Platform.
We reserve the right to access and disclose any information as needed to comply with legal obligations, enforce these Terms, detect fraud, or protect the rights and safety of "RQM" and its users.

"RQM" is based in the United States, and our Platform is designed to comply with the laws of the United States and the State of Florida.
If you access or use the Platform from outside the United States, you do so at your own risk and are responsible for compliance with any local laws or regulations that may apply to you.
By using the Platform, you consent to your data being transferred to and processed in the United States, and you acknowledge that U.S. data protection laws may differ from those in your jurisdiction.
We make no representations or warranties that the Platform is appropriate, available, or legally permitted for use outside the United States. If your local laws restrict your use of the Platform or any of its features, it is your sole responsibility to comply or discontinue use.
